Anne Hathaway’s boyfriend is in the clear: The Manhattan District Attorney’s office has declined to prosecute Raffaello Follieri, who was arrested in April for allegedly writing a $215,000 bad check.
Manhattan DA spokeswoman Tracy Golden tells PEOPLE that Follieri was cleared because he fully reimbursed John Morrongiello for the $215,000 check Follieri wrote him, and Morrongiello, of Colts Neck, N.J., no longer wishes to pursue the case.
Follieri, 29 - who has been dating Hathaway, 25, since 2004 - was expected to appear in Manhattan Criminal Court Monday.

But this wasn’t the case of a starlet-gone-wild. Hathaway was working, filming scenes for her comedy
Bride Wars, which costars Kate Hudson.
According to Stanley Wong, whose family owns Kowloon, “The scene was very
funny. Basically %26#91;Hathaway’s character%26#93;’s on spring break. She’s
getting drunk and basically making a home video.”

a stand-in for a spring break-like venue. Lauren Birmingham, the
restaurant’s rep, tells PEOPLE the scene will be used in the film to
sabotage Hathaway’s character who is getting married the same day as her
friend (played by Hudson).
But when the cameras stopped rolling, Hathaway was sweet as can be, Wong
says. She even posed for a picture with him. Before filming, “she was really
quiet,” he says. “And then she really got into the scene!”

Follieri, 29, was released Thursday evening on a desk-appearance ticket after allegedly bouncing a $215,000 check, according to reports. His lawyer told the New York Daily News that the “underlying obligation has been paid.”
Since moving to New York over four years ago to start a business redeveloping Roman Catholic Church properties, Follieri, the scion of a powerful Italian real estate family that boasted strong ties to the Vatican, has been the subject of a number of lawsuits, including one filed by billionaire supermarket magnate - and Bill and Hilary Clinton associate - Ron Burkle.
In the lawsuit, filed in May of last year in Delaware, Burkle alleges that
Follieri took more than $1 million of his company’s money to pay for an extravagant
lifestyle for the couple, which included a $40,000 a month penthouse apartment in the Trump Tower, private jet travel, lavish spending sprees, and five star dog care for the couple’s Labrador Esmeralda.

Hathaway, 24, who sits on the board of the Follieri Foundation, a charitable
group started by her boyfriend, will next be seen this summer opposite Steve
Carell in Get Smart and is currently shooting the Bride Wars with Kate Hudson in New York.
