Kevin Federline has no plans to ask a family court to investigate his son’s weekend health scare while in ex-wife Britney Spears’s care, his lawyer says.

“We’re not going to jump to conclusions right now,” attorney Mark Vincent Kaplan tells E!. “I don’t anticipate there being a hearing. I anticipate that Kevin and Britney as concerned parents will exchange information and satisfy themselves that what happened was a freak occurrence and do what they have to do to make sure that it doesn’t happen again.”

Jayden, 2, was hospitalized overnight on Sunday in McComb, Miss., after suffering a “terrible allergic reaction” to something he ingested, a source close to the Spears family tells PEOPLE.

“Kevin was considering going to Louisiana (after the hospitalization),” says Kaplan, “but the information that we had was Jayden was already checked out. There wasn’t an emergency.”

Britney Spears’s trip home with her sons this weekend took an unexpected serious turn when her 2-year-old Jayden was rushed to a Kentwood-area hospital at 1:30 p.m. Sunday. But the toddler is not in danger, according to a source close to the family.

“He’s doing fine,” the source tells PEOPLE. “They kept him overnight.”

Jayden was taken to the hospital after suffering “a terrible allergic reaction. He had hives, was itchy and irritable,” according to the source, who says that Britney Spears and her mother, Lynne, spent the night at the hospital with Jayden.

As for what caused the reaction, “They’re just not sure,” said the source.

Just prior to the incident, Britney, Jamie Lynn, Bryan, Lynne and Jamie Spears were enjoying a fun afternoon at the family’s Serenity mansion, the boys’ first trip out of California with their mother since she lost custody.

A rep for Britney’s ex-husband Kevin Federline had no comment.

As if her life didn’t already have enough drama, early this morning Britney Spears’ brother Bryan was spotted leaving a hospital in McComb, Mississippi with her son Sean Preston Federline and a nanny.

According to sources on the scene, the Spears family made a trip to the emergency room late last night for Jayden James. Depending on the situation, this may not bode well for Brit, who was recently allowed to take her kids out of California for the first time since she lost custody to her ex-husband Kevin Federline.

In related news, it sounds like Britney will be celebrating Thanksgiving Day overseas due to a scheduled performance on the French show “Star Academy” on November 28th.

The Turkey Day gig comes just ahead of her big comeback album release next month. “Circus” is slated to hit stores on December 2nd.

Britney Spears arrived Friday in Louisiana with her sons for a family visit to her hometown in Kentwood.

It was the first time the 26-year-old singer was allowed to take Preston, 3, and Jayden, 2, out of California since losing all custody rights earlier this year to ex-husband Kevin Federline.

“This is a terrific indication of the progress she’s made, and the growing trust between the two parents,” says a source close to Spears. “It was arranged cooperatively between Kevin and the lawyers.”

Since reaching a custody settlement in July, Spears currently has two visits and an overnight per week with her children.

Adds the source: “Britney just wanted to get some family time in and show the boys Louisiana, now that they’re getting older.”

While its been Britney Spears that has taken on the schoolhouse pick-up duties as of late, Kevin Federline stepped out to grab up Sean Preston and Jayden James from school in Los Angeles on Friday (October 31).

With the two boys dressed up in matching bumble bee outfits, K-Fed and his nanny helper toted the young’ens out from the learning experience and on to bigger and better things - trick-or-treating!

And though there have been those who’ve questioned Federline’s parenting skills, he definitely has the support of Britney’s mother, Lynne Spears.

Lynne told press, “I do like Kevin. He’s been good to us. He has included Jamie and I. He could have been a real pill about a lot of things, but he wasn’t. He worked with us, and I think he’s tried to make things good for the boys.”

Britney Spears’s father Jamie testified in her misdemeanor driving-without-a-license trial Thursday that California isn’t her permanent residence.

“Her home is Louisiana,” he said in a Southern drawl. As for when she’ll be returning to Louisiana, “There’s plans right now,” he said.

The 26-year-old pop star, who was not in court, faces up to six months in jail and a $1,000 fine on a charge of not having a valid license at the time of an August 2007 fender-bender. She had a Louisiana license, but prosecutors contend Spears should have had a California license as a resident of the state.

The prosecution rested its case after calling one witness: Department of Motor Vehicles investigator Gary Edmonds, who testified a DMV document showed that Spears was not licensed in California on the day of the accident.

Jamie Spears, 56, who legally controls his daughter’s affairs, took the stand for the defense, saying that his daughter is in California for the sake of her two sons.

Britney, whose ex-husband Kevin Federline has primary custody of their children, will move back to Louisiana once “we can travel with the kids (out of state) and spend time there,” her father said.

He went on to describe numerous family members who currently live there, including Britney’s mother, sister, aunts, uncles, and her newborn niece.

Britney currently owns homes in Louisiana, New York, Florida and California. She acquired her Louisiana home “eight and a half years ago,” he said.

Asked where he lives, Jamie replied, “I live with her. In Beverly Hills.” Then asked for his primary residence, he said, “Louisiana.”

Prosecutor Michael Amerian countered by stating that Spears’s voter status in Louisiana is inactive because she hasn’t voted there for some time. He also showed the jury her divorce filings, which indicated she was a California resident.

Closing arguments were set for Friday morning.

In an upcoming documentary, Britney Spears candidly discusses her loneliness and her regrets about her much-publicized erratic behavior.

“I sit there and I’ll look back and I’m like: I’m a smart person. What the hell was I thinking?” the pop star says in the 90-minute film, tentatively titled For the Record, produced in partnership with MTV.

In a video clip from the film, the 26-year-old Spears alludes to her tumultuous past: her divorce from Kevin Federline, forced psychiatric hospitalizations and loss of custody of her two sons.

“I’ve been through a lot in the past two or three years, and there’s a lot that people don’t know,” she says.

The documentary airs on MTV on Nov. 30, two days before the release of her new album, Circus.

Britney Spears’s bad month just got worse: She has been charged with hit-and-run causing property damage and driving without a valid license, the Los Angeles City Attorney said Friday.

The charges stem from a fender-bender in a store parking lot on Aug. 6. Spears, 25, made a wide, right turn into a parking space and scraped another car’s bumper. (The incident was captured on video by celeb photo agency X17.)

“According to the DMV, Ms. Spears was never issued a California license - ever,” City Attorney’s spokesman Frank Mateljan tells PEOPLE.

The other car’s owner filed a police report at a North Hollywood station.

Her arraignment is set for Oct. 10 in a Van Nuys, Calif., court. If convicted on both misdemeanor charges, she faces up to a year in jail, Mateljan says.

Pasadena attorney Richard Hutton, best known for representing Paris Hilton in her probation-violation case earlier this year, says California residents must get a California driver’s license within their first 10 days as a resident.

Spears has been pulled over several times in recent years with being cited for the license violation. Hutton (who is not involved in the Spears case) says it’s possible officers were persuaded she maintains a residence in Louisiana and legitimately considers herself more a Louisiana resident than a California resident.

Overall, Hutton says, the charges are “minor stuff” and Spears could escape with a fine and probation.

The charges are just the latest headache for Spears, who earlier this week was ordered by a judge to undergo random drug tests. The judge in her custody fight with Kevin Federline found that she is a “habitual, frequent and continuous” user of alcohol and controlled substances, and now must submit to random twice-weekly testing.

One week after her ex husband Kevin Federline headed to Las Vegas, it was now Britney Spears’s turn to hit Sin City this weekend.

Their visits to Vegas, however, couldn’t have been more different. While Federline bounced around from several clubs last weekend, Spears’s trip was more low-key, consisting mainly of relaxing by the pool and taking in a show over Labor Day weekend.

On Sunday, rather than staying by her private pool, Spears made her way to Bare Pool where she sipped Fiji bottled water and sunned in the VIP area.

“Her body looked great,” an onlooker said. “It looks like she’s getting her body back, back to the old Britney.”

Staying an hour and a half, Spears texted from her phone and rarely moved from her lounge chair, getting up only to take a quick dip in the pool. Wearing a bikini top and jean shorts, Spears hung out with a group of friends that included her hairstylist Kim Vo.

While Spears basked in the high Vegas heat, a familiar face meandered through the Mirage - her ex boyfriend, photographer Adnan Ghalib. The paparazzo and Spears did not see each other in public though they were within a few yards of each other several times.

After lounging by the pool, Spears made a quick run to Siegfried and Roy’s Secret Garden and headed to her room for several hours. She later took in Cirque du Soleil’s Love show before calling it a night.

The singer, who recently appeared in ads for the upcoming MTV Video Music Awards, is rumored to make an appearance on the Sept. 7 show. Spears is nominated for three Moonmen this year - video of the year, best female video and best pop video for “Piece of Me.”

Among Shar Jackson’s guest list for her 32nd birthday party: family, friends and Kevin Federline.

The father of four - including two children with Jackson - was at Las Vegas’s Blush Nightclub on Friday helping his ex celebrate, and even giving her a birthday hug.

“We were friends before we were a couple and we’re always going to be friends,” Jackson told PEOPLE at Wynn Las Vegas before entering the party. “We have two amazing kids together. Kevin is my boy.”

Jackson, however, insists that there is no talk of rekindling the flame. “We have passed that stage.”

Jackson’s party was the first stop for Federline in night that saw him dropping by newly opened Lavo, Tao and Prive Las Vegas, where Jackson also joined him.

After seeing each other for the third time in 12 hours, Federline took a break from partying at a table in the club’s kitchen, then headed to the deejay booth to publicly wish Jackson a happy birthday into a microphone.

While rumors persist that Federline’s other ex, Britney Spears, may be planning a performance at the MTV Video Music Awards next month, she has a backer in Jackson.

“I hope she does it, I hope she goes for it and kills it,” Jackson said.
